Terms of Service
Effective date: 01 Oct 2026. These Terms govern access to and use of OLAPAL’s websites, applications and related services (the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you use the Services for an organisation, you confirm that you have authority to bind it. If you disagree, do not use the Services.
1. Eligibility and Accounts
You must be at least 13 years old and legally able to accept these Terms. You must provide accurate information, keep your credentials confidential, and promptly report unauthorised access. You are responsible for activity under your account and may not transfer or create accounts for others without permission. OLAPAL may reject, reclaim, suspend, or disable accounts or identifiers that are misleading, insecure, unlawful, or infringe third-party rights.
2. Your Content
You retain ownership of content you submit. You grant OLAPAL a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, modify, display and distribute that content only as needed to operate, improve and promote the Services according to your settings. You confirm that you have the necessary rights and that your content is lawful. The licence ends when content is deleted, except where it remains in backups, is required by law, or has been shared and retained by others. Public content may be accessed and reshared by anyone. OLAPAL may use feedback without restriction or compensation.
3. Acceptable Use
You must not use the Services to break the law; violate privacy, intellectual-property or other rights; harass, threaten, deceive or discriminate; send spam; distribute malware; seek another person’s credentials; scrape or access the Services by unauthorised automated means; reverse engineer the Services; or disrupt, overload or bypass security controls. You must not upload unlawful, exploitative, hateful, pornographic or gratuitously violent material. OLAPAL may investigate suspected misuse and remove content, restrict features, or cooperate with lawful authorities.
4. Privacy and Communications
OLAPAL processes personal data in accordance with its Privacy Policy and applicable law. You consent to service-related electronic communications. Marketing messages will be sent only where permitted, and you may opt out at any time. International data transfers, where necessary, will use legally required safeguards.
5. Payments and Subscriptions
You authorise OLAPAL to charge the fees, taxes and recurring amounts shown at purchase. Subscriptions renew automatically unless cancelled before renewal. Except where law requires otherwise, fees are non-refundable. Promotional credits are non-transferable, have no cash value and expire under their stated conditions. OLAPAL may suspend paid features for overdue amounts. Your network or mobile provider may charge separate data or messaging fees.
6. OLAPAL Property and Limited Licence
OLAPAL and its licensors own the Services, software, branding and related intellectual property. Subject to these Terms, OLAPAL grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services. You may not copy, sell, modify, distribute or exploit them except as expressly permitted.
7. Service Availability and Termination
OLAPAL may modify, suspend or discontinue any part of the Services. You may stop using the Services or close your account at any time. OLAPAL may suspend or terminate access for breach, non-payment, security risk, legal requirement or material harm to OLAPAL or others. Where reasonably practicable, OLAPAL will give notice. Provisions intended to survive termination—including ownership, payment, indemnity, disclaimers, liability and dispute terms—remain effective.
8. Warranties and Liability
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, OLAPAL disclaims implied warranties and does not guarantee uninterrupted, secure or error-free operation. OLAPAL is not responsible for third-party services, content or conduct. Neither party is liable for indirect, incidental, special, punitive or consequential loss. OLAPAL’s total liability arising from the Services will not exceed the fees you paid OLAPAL during the preceding 12 months. These limits do not exclude liability that cannot lawfully be limited.
9. Indemnity
If your actions or content cause a third-party claim, you will indemnify OLAPAL and its personnel against resulting losses, liabilities and reasonable legal costs, to the extent permitted by law.
10. Copyright and Rights Complaints
If you believe content infringes your rights, send a clear notice to info@olapal.com identifying the work, the disputed material and its location, your contact details, the basis of your claim, and your signature or authority to act. OLAPAL may remove disputed content and terminate repeat infringers.
11. Governing Law and Disputes
These Terms are governed by the laws, excluding conflict-of-law rules. The parties will first attempt good-faith negotiation and, where appropriate, mediation before commencing proceedings in the courts of [location]. Mandatory consumer rights and lawful remedies remain unaffected.
12. Changes and General Terms
OLAPAL may update these Terms and will provide reasonable notice of material changes. Continued use after the effective date constitutes acceptance, unless applicable law requires express consent. These Terms and referenced policies form the entire agreement regarding the Services. If any provision is unenforceable, the remainder continues in effect. Delay in enforcement is not a waiver. You may not assign these Terms without OLAPAL’s consent; OLAPAL may assign them as part of a reorganisation, merger or sale. No third party receives rights under these Terms. Notices may be delivered electronically. Questions may be sent to info@olapal.com
